Understanding Holiday Entitlement…
Statutory Holiday Entitlement:
In the UK, every worker, including temporary and agency workers, is entitled to a minimum of 5.6 weeks of paid annual leave. This is often referred to as statutory holiday entitlement.
For full-time workers, this equates to 28 days, including public holidays, if applicable.
Accrual for Temporary Workers:
As a temporary worker employed through a recruitment agency, your holiday entitlement accumulates as you work.
You earn holiday entitlement based on the hours you work. This accrual is a percentage of your total working time.
Claiming Your Holiday Accrual & Keeping Track of Your Holiday Entitlement:
When you wish to take a holiday, you should inform your recruitment agency in advance in writing.
Every agency will have different rules regarding the amount of notice that you need to give them in order to book your holiday, so it’s good to check when you first start working to make sure you understand the process and how much notice you need to give them to avoid disappointment.
Calculating Your Pay During Holidays:
When you take a holiday, your pay should be calculated based on your average earnings over the preceding 52 weeks or the total amount of time you have been working for the agency, whichever is less.
Understanding Bank Holidays:
In most cases you will need to request a paid time off if you are not working during a Bank Holiday (no matter if this is due to your employer not requesting you or you taking a day off).
Temporary to Permanent Transition:
If you transition from a temporary to a permanent role with the same employer through the agency, any outstanding holiday that you have accrued during your time with the agency, will be paid to you upon your request of holiday and P45.
